Government Filing Fees in India
The trademark registration cost in India depends on the type of applicant and the number of classes under which protection is sought.
The Controller General of Patents, Designs and Trademarks follows a two-tier fee system:
1. Small Entities (Individuals, Startups, MSMEs)
If you are:
- An individual
- A sole proprietor
- A DPIIT-recognised startup
- An MSME with Udyam registration
The government filing fee is:
₹4,500 per class (online filing)
If filed physically, the fee increases to:
₹5,000 per class
2. Other Entities (Companies, LLPs, Partnerships)
For larger businesses and entities not qualifying as small entities:
₹9,000 per class (online filing)
For physical filing:
₹10,000 per class
Online filing is strongly recommended due to lower fees and faster processing.
Fast-Track Examination Fees
The standard examination timeline ranges from 6 to 18 months. Businesses requiring urgent clearance may opt for expedited examination.
The additional government fee for fast-track processing is:
- ₹20,000 for small entities
- ₹40,000 for other entities
This fee is charged in addition to the regular filing fee and is available only for online applications.
Renewal Costs and Validity
A registered trademark in India remains valid for 10 years from the date of registration.
The renewal fee is:
₹10,000 per class (online)
If renewal is delayed:
- During the 6-month grace period: ₹13,500
- Restoration after expiry (within 1 year): ₹18,000
Failure to renew within this period may result in removal from the register, requiring a fresh application.
